Terms of service

These terms are an agreement between you and Mailnitrix ("Mailnitrix", "we", "us") and govern your use of the Mailnitrix website, application and related services (the "Service"). By creating an account or using the Service, you agree to them. If you use the Service for an organisation, you confirm that you can accept these terms on its behalf.

1. Your account

You must be at least 18 years old and give accurate information when you sign up. You are responsible for keeping your login details safe and for everything that happens under your account. Tell us straight away at security@mailnitrix.com if you think someone has accessed it without permission.

2. How the Service works

Mailnitrix sends email from mailboxes that you connect and control, such as Gmail, Google Workspace, Outlook.com and Microsoft 365 accounts. You are the sender of every email sent through your account, and you are responsible for its content, its recipients and its compliance with the law.

You also agree to follow the acceptable use policy and the terms of the email providers whose mailboxes you connect.

3. Plans, billing and emails

  • Paid plans are billed in advance, monthly or yearly, until you cancel.
  • Each plan includes a number of emails per billing period. One email is one message accepted for delivery to one recipient through a campaign or a one-off send. Warmup emails and sends that fail before they are accepted do not count.
  • On paid plans, emails beyond your allowance are charged at your plan's published rate per 1,000 emails if you choose to keep sending.
  • Unused emails do not roll over to the next billing period.
  • Prices exclude taxes unless stated. Where tax applies, it is added at checkout.
  • We may change prices with at least 30 days' notice. Changes apply from your next billing period.

4. The free plan

The free plan is offered at our discretion. We may change its limits with notice, and we may close free accounts that have been inactive for 12 months after warning you by email.

5. Cancellation and refunds

You can cancel at any time. Cancellation takes effect at the end of your current billing period and you keep access until then. Refunds are covered by our refund policy.

6. Your data

You own the content and contact data you upload or create in the Service. You give us permission to store and process it only as needed to provide the Service. When your content includes personal data about other people, you are the controller of that data and we process it on your behalf, as described in our privacy policy. A data processing agreement is available on request.

You are responsible for having a lawful basis to email the contacts you upload.

7. Suspension

We may pause campaigns or suspend accounts, with notice where reasonable, if:

  • your use breaks these terms or the acceptable use policy;
  • your sending puts the Service, other customers or email providers at risk;
  • payment fails and isn't resolved after we've told you; or
  • the law requires it.

8. Third-party services

The Service depends on Google, Microsoft and other providers. Changes to their services, limits or policies may affect what Mailnitrix can do, and we are not responsible for their actions.

9. Changes to the Service

We improve the Service continually and may add, change or remove features. Any feature we mention as planned is not a commitment and is not included in any plan until it is released.

10. No guarantee of results

We work hard to protect your mailboxes, but no one can guarantee inbox placement, open rates, replies or other results. The Service is provided "as is" and "as available", without warranties beyond those that cannot be excluded by law.

11. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.

12. Indemnity

You agree to compensate us for claims, losses and costs arising from the emails you send, the data you upload, or your breach of these terms or the law.

13. Ending the agreement

You can close your account at any time. We may end this agreement if you seriously or repeatedly break it. After your account closes, we delete your data within 30 days, except where we must keep it by law. Export anything you need before closing your account.

14. Governing law

These terms are governed by the laws of India, and the courts of India have jurisdiction over any dispute, unless the law where you live gives you rights that cannot be overridden.

15. Changes to these terms

We may update these terms. If a change is significant, we'll tell you by email or in the app at least 30 days before it takes effect. Continuing to use the Service after that means you accept the new terms.
